These terms govern your use of Clea and explain what the service does, what it does not do, and the responsibilities that sit with you, Clea and participating healthcare providers.
1. Who these terms are with
These Terms of Use are between you and Clea Mental Health Pty Ltd, trading as Clea. By creating an account or using Clea, you agree to these terms.
2. What Clea is
Clea is a healthcare navigation service. It helps people organise information into a Care Profile, understand practical care pathways, compare factual provider information, ask navigation questions, and choose whether to request a handoff or booking with a participating clinic.
Clea is designed to make the path into healthcare clearer. It is not the healthcare provider delivering your clinical care.
3. Clea is not medical advice
Clea does not diagnose a medical condition, interpret symptoms as proving a diagnosis, prescribe medication, recommend a treatment plan, determine whether a medicine or procedure is appropriate, or replace your GP, neurologist, pharmacist or other qualified healthcare professional.
Information provided by Clea, including by AI Concierge, is for healthcare navigation and general informational purposes only.
4. Emergencies and urgent symptoms
Clea is not an emergency or urgent care service and should not be used to assess whether a medical emergency is occurring.
In Australia, call 000 or attend an emergency department for an emergency. If you are unsure what level of care you need, contact healthdirect on 1800 022 222 or another appropriate healthcare service.
5. Your account
You are responsible for providing accurate account information, keeping your login credentials secure, and notifying Clea if you believe your account has been accessed without authority.
You must not access another person’s account without authority, attempt to bypass security controls, scrape the service, interfere with the service, or use Clea for unlawful purposes.
6. Children and people you represent
If you enter information about a person under 18 or another person who is not using the account themselves, you confirm that you are their parent, guardian or are otherwise authorised to provide that information and act on their behalf.
7. Your Care Profile
Your Care Profile is based on information you provide. Clea does not independently verify all member supplied health information.
Information you import or connect from another health platform, clinical record or migraine application remains dependent on the accuracy, completeness and format supplied by that source. Clea may normalise or organise imported information for display while retaining source provenance.
Interoperability varies by device, operating system, third-party API, permissions and partner terms. Clea does not claim a direct integration with a third party merely because you can import a user-generated export from that service.
You are responsible for checking that information you choose to share with a clinic is sufficiently accurate for the purpose of the handoff. A Care Profile is not a medical record prepared by a clinician and should not be treated as a substitute for clinical history taking.
8. AI Concierge
AI Concierge is designed to answer practical navigation questions. Artificial intelligence can make mistakes, misunderstand context or produce incomplete information.
You should verify important healthcare, referral, funding, fee and booking information with the relevant clinic, provider or official source before relying on it.
9. Provider information and ordering
Clea may show information supplied by clinics, providers or reliable public sources, including stated areas of focus, services, referral information, telehealth, fees and availability.
Provider information can change. You should confirm material details with the clinic before booking.
Clea does not represent that a provider is clinically best or medically suitable for you merely because that provider appears in Clea. Commercial payment by a provider does not buy a higher clinical ranking.
9A. Provider experience ratings
If you submit a clinician or clinic rating, you confirm that the rating reflects your own patient experience and that you personally attended care with that clinician or clinic.
A 1–5 rating is a patient-experience signal. It is not a clinical-quality score, diagnosis, treatment-outcome measure, statement that a clinician is safe or unsafe, or recommendation that another person should choose or avoid that provider.
Clea may verify, hold, reject, remove or investigate ratings where necessary to prevent fraud, duplicate weighting, manipulation or misuse. Ratings linked to completed Clea bookings may be verified automatically; other ratings may require manual verification.
Public clinician and clinic averages appear only after Clea’s minimum verified-response threshold is met. Provider payment does not alter ratings or buy a higher clinical ranking.
10. Handoffs and bookings
When you request a handoff or booking, Clea may send or make available selected Care Profile and booking information to the provider you chose.
A request sent through Clea is not a guarantee that a clinic will accept you as a patient, offer a particular appointment time, provide a particular treatment, or determine that a service is clinically appropriate.
The clinic is responsible for appointment confirmation, clinical assessment, treatment decisions, professional obligations, its own cancellation policy and any clinic fees.
11. Fees and payments
Clea may offer free and paid features over time. If Clea introduces a charge to members, the price, billing period and any renewal terms will be disclosed clearly before you agree to pay.
Fees charged by a healthcare provider are separate from Clea unless Clea expressly says otherwise. Provider fees, Medicare rebates and funding eligibility can change and should be confirmed with the clinic or official source.
12. Third party services
Clea may link to or integrate with clinic booking systems, telehealth services, maps, health information sources and other third party services. Those services are controlled by their operators and may have separate terms and privacy policies.
13. Intellectual property
Clea and its licensors own the intellectual property in the Clea service, brand, software, content and design, excluding information that belongs to users, providers or third parties.
You may use Clea for your personal healthcare navigation needs. You must not copy, reproduce, sell, reverse engineer or commercially exploit the service except where permitted by law or with Clea’s written permission.
14. Service availability and changes
We aim to keep Clea available and accurate, but we do not guarantee uninterrupted access. We may change, improve, suspend or discontinue features where reasonably necessary, including for maintenance, security, legal or product reasons.
15. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.
16. Liability
To the maximum extent permitted by law, Clea is not responsible for clinical decisions made by independent healthcare providers, treatment outcomes, provider acts or omissions, or losses caused by information that a user or provider supplied inaccurately.
Where liability cannot be excluded, any limitation in these terms applies only to the extent permitted by law and does not reduce rights that cannot lawfully be limited.
17. Suspension and account closure
You may stop using Clea at any time and may request account closure.
We may restrict or suspend access where reasonably necessary to protect members, clinics, Clea or the security and integrity of the service, or where these terms are materially breached.
18. Privacy
Our Privacy Policy explains how we handle personal information, including sensitive health information. It forms part of the framework under which Clea operates.
19. Changes to these terms
We may update these terms as the service changes or legal requirements evolve. If a change materially affects existing members, we will take reasonable steps to provide notice before it takes effect.
20. Governing law and contact
These terms are governed by the laws of New South Wales, Australia. Courts with jurisdiction in New South Wales may hear disputes, subject to any rights you have under applicable consumer law.
